1. Agreement to Terms
By accessing or using the services of NovaAW Software LLC (“Company”, “we”, “us”), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use our services.
2. Service Delivery
All services are delivered under a defined scope agreed with the client before work begins. Public starting prices are planning references; the final scope, timeline, deliverables, and fee are confirmed in a proposal or written agreement.
3. Fees, Invoices & Scope
Project fees, invoicing milestones, and payment terms are defined in the applicable proposal or agreement. Each invoice relates to an agreed engagement or delivery milestone, and changes to scope may require a written adjustment to fees or timing.
4. No Refunds
Amounts paid for work already started are non-refundable unless the applicable agreement or law provides otherwise. Any cancellation terms for remaining work are defined in the project agreement. Please contact us before approving an engagement if you have questions.
5. Intellectual Property
Unless otherwise specified in writing, all software, designs, and deliverables produced by NovaAW Software LLC remain the property of the client upon full payment. NovaAW Software LLC retains the right to reference the work in its portfolio unless otherwise agreed.
6. Limitation of Liability
NovaAW Software LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services, even if advised of the possibility of such damages.
7. Governing Law
These terms are governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.
